Public officials’ undeclared assets and entrepreneurial activities in Kakheti Municipalities

Transparency International Georgia has been studying public officials’ asset declarations and checking whether information entered by these officials matches that in the Public Registry. At various times, the organization has uncovered incomplete asset declarations, participation of public officials and their family members in entrepreneurial activities as well as other kinds of irregularities in the municipalities of Ajara, Racha-Lechkhumi-Kvemo Svaneti, Imereti and other regions.

This time, the organization examined the consistency of the information provided by all public officials of the municipalities of the Kakheti Region in their asset declarations with the information in the Public Registry.

The study has shown that:

  • In some cases, public officials failed to indicate assets registered in their name in the Public Registry (mainly, land plots) – a violation of Paragraph “d” of Article 15 of the Law on Conflict of Interest and Corruption in Public Institutions, according to which real estate owned by a public official and his or her family members must be entered into his or her asset declaration.


Such cases were discovered when studying the asset declaration of the Kvareli Municipality Council Chairman Jemal Shaverdashvili – he failed to indicate the ownership of over 15 land plots in his declaration; Paata Nioradze, chairman of the Commission on Economic and Property Management Issues of the Kvareli Municipality Council, failed to include the information about four land plots; the Deputy Mayor of the municipality of the self-governing town of Telavi, Levan Liluashvili, failed to indicate the ownership of six land plots in his declaration;

 

  • The information provided by officials often is not consistent with the Public Registry’s information about the assets they own; such were the cases of the Deputy Chairman of the Dedoplistskaro Municipality Council, Nugzar Papiashvili, the First Deputy Head of Administration of the Gurjaani Municipality, Elguja Giorgadze, and other public officials;

 

  • Several public officials are still participating in entrepreneurial activities, which is a violation of the law: according to Paragraph 4 of Article 13 of the Law on Conflict of Interest and Corruption in Public Institutions, a public official is not allowed to hold any positions in an enterprise;

 

 

  • There are cases when public officials gave up on entrepreneurial activities – fully in accordance with the law;

 

  • The participation of companies owned by public officials’ family members in public procurement does not arouse suspicions of the existence of corrupt deals but there are cases when the companies connected to their family members were awarded service contracts on the supply of goods with contract value under GEL 5,000 through a simplified procurement procedure.

 

Dedoplistskaro Municipality

Solomon Ghorashvili, first deputy head of the Dedoplistskaro Municipality Administration, submitted a public official’s asset declaration on 18 September 2015. Ghorashvili did not indicate in the document that he owns 46.3 percent of shares of Mirzaani, LLC (identification code: 228533600) registered on 19 September 2010 and is also the head of this company.

According to the State Procurement Agency, Mirzaani, LLC has not participated in any tenders and administrative bodies have never signed any direct purchase contracts with it either. We do not know whether Solomon Ghorashvili received income from Mirzaani, LLC.

In the declaration submitted on 18 September 2015, Solomon Ghorashvili indicated that he owns real estate of 16 sq. m in the Lilo Settlement of the Samgori District in Tbilisi, which is not confirmed by the Public Registry’s information.

Dedoplistskaro Municipality Council Chairman Zviad Javakhishvili submitted a public official’s asset declaration on 3 August 2015. Javakhishvili failed to indicate in the declaration that his father, Vazha Javakhishvili, owns 100 percent of shares of Karteli, LLC (406025091) and is the director of this company; Zviad Javakhishvili himself was the owner of 50 percent of shares of this company until 4 February 2013 but then transferred the ownership to his father. Since February 2013, the company is registered as a food processing enterprise.

According to the State Procurement Agency, Karteli, LLC has never participated in any tenders and administrative bodies have never signed any direct purchase contracts with it either. We do not know whether Vazha Javakhishvili received income as a result of entrepreneurial activities in Karteli, LLC.

According to Zviad Javakhishvili’s declaration, no property is registered in his name; as for his family members, after the submission of the declaration, on 13 October 2015, the Council Chairman’s father, Vazha Javakhishvili, purchased land plots of 6,006 and 6,005 sq. m and another one of 6,500 sq. m on 27 January 2016 in the village of Mirzaani.

Nugzar Papiashvili, deputy chairman of the Dedoplistskaro Municipality Council, submitted a public official’s asset declaration on 31 July 2015. The information about the ownership of assets that Nugzar Papiashvili indicated in the declaration is not consistent with the information about the property registered in his name in the Public Registry. Specifically, Papiashvili stated in the declaration that, together with Paata Marauli, he jointly owns 50 sq. m of non-residential property; according to the Registry, however, their joint property includes a non-agricultural land plot of 887 sq. m of and a building of 852 sq. m (cadastre code: 52.11.34.041.) as well as a building of 88 sq. m and a non-agricultural land plot of 152 sq. m, in the village of Kvemo Kedi of the Dedoplistskaro Municipality none of which were indicated in the declaration.

Papiashvili indicated in his declaration that he owns a residential apartment (with an area of 100 sq. m) at 1, Mosashvili Street in Tbilisi but only 64 sq. m (01.14.11.002.003.01.060) are registered in his name in the Public Registry.

Papiashvili also indicated in his declaration that he owns an agricultural land plot (pasture) of 1,490,000 sq. m and 1,000 sq. m of non-residential property in the village of Kvemo Kedi of the Dedoplistskaro District; the property registered in his name with the Registry, however, include a land plot of 1,420,000 sq. m (cadastre code: 52.11.32.063) and a land plot with four different buildings (cadastre code: 52.11.32.064) with the area of 1,135.92 sq. m.

He also indicated in his declaration that he owns a land plot of 560,000 sq. m in the village of Kvemo Kedi in the Dedoplistskaro Municipality; according to the Public Registry, however, Papiashvili owns a land plot of 330,000 sq. m.

According to the declaration, Papiashvili also owns a house (200 sq. m) in Kvemo Kedi in the Dedoplistskaro Municipality but it does not show in the Registry.

In addition, the following properties are registered in his name but were not indicated in the declaration:

  • An agricultural (household economy) land plot of 3,348 sq. m with a building of 188 sq. m (cadastre code: 52.11.33.016) in Kvemo Kedi, Dedoplistskaro District;
  • Undeclared 4 sq. m basement (cadastre code: 01.14.11.002.003.01.611) at 1, Mosashvili Street in Tbilisi;
  • An agricultural land plot (pasture) of 70,000 sq. m with four various buildings (cadastre code: 52.11.32.064) in Kvemo Kedi, Dedoplistskaro District;
  • An agricultural land plot (arable) of 199,988 sq. m (cadastre code: 52.11.37.049) in Kvemo Kedi (Shiraki), Dedoplistskaro District.

Soso Jamaspishvili, chairman of the Budget and Finance Commission of the Dedoplistskaro Municipality [Council],  submitted a public official’s asset declaration on 21 August 2015. Jamaspishvili did not include in full the real estate registered in his and his family members’ name (five land plots) in the declaration, specifically:

  • An agricultural land plot of 236,829 sq. m in the village of Zemo Machkhaani (cadastre code: 52.01.42.149);
  • He also owns a land plot of 1,135,546 sq. m (cadastre code: 52.01.42.150) in the same village but his declaration indicates ownership of a land plot of 1,500,000 sq. m, which does not correspond to the area of the land plot registered with the Registry;
  • Soso Jamaspishvili also failed to declare a land plot of 123,780 sq. m (cadastre code: 52.01.42.148) which is registered with the Registry;
  • Soso Jamaspishvili also owns a land plot of 814 sq. m (cadastre code: 52.01.32.107) and a land plot of 72 sq. m (cadastre code: 52.01.32.108) in the village of Zemo Machkhaani in Dedoplistskaro, which do not appear in his declaration.

According to his declaration, Soso Jamaspishvili’s son, Shavlego Jamaspishvili (personal number: 14001019533), owns a land plot of 12,200 sq. m in the village of Zemo Machkhaani (Shiraki) in Dedoplistskaro; according to the Public Registry, a land plot of 11,997 sq. m (cadastre code: 52.47.31.022) is registered in his name.

Shavlego Jamaspishvili owns an undeclared agricultural land plot of 12,001 sq. m in the village of Anaga in the Sighnaghi Municipality (cadastre code: 56.08.43.007); Shavlego Jamaspishvili also owns an undeclared basement of 5.62 sq. m at 3, Shiraki Street in Tbilisi (cadastre code: 01.17.13.035.002.01.508).

According to the declaration, Soso Jamaspishvili’s daughter, Esma Jamaspishvili (personal number: 14001008261), owns residential property of 120 sq. m. According to the Public Registry, however, she owns a land plot of 358 sq. m and buildings on it with an area of 122.47 sq. m and 12.0 sq. m (cadastre code: 52.01.32.035); also, according to the declaration, Esma owns a land plot of 600 sq. m in Zemo Machkhaani in Dedoplistskaro, while according to the Registry, Esma Jamaspishvili owns a land plot of 739 sq. m (cadastre code: 56.06.49.016).

Givi Gigauri, chairman of the Commission on Economic and Property Management Issues of the Dedoplistskaro Municipality [Council], submitted his asset declaration on 12 February 2016. Gigauri failed to indicate the following real estate in his declaration (seven land plots):

  • An agricultural land plot of 1,490,000 sq. m (cadastre code: 52.30.31.069; previous number: 52.05.05.077) in the village of Gamarjveba (Taribana) in Dedoplistskaro;
  • An agricultural land plot of 3,470,066 sq. m (cadastre code: 52.05.05.044) in the village of Gamarjveba (Taribana) in Dedoplistskaro;
  • An agricultural land plot of 699,989 sq. m (cadastre code: 52.29.31.010; previous number: 52.07.07.070) in the village of Japaridze in Dedoplistskaro;
  • An agricultural land plot of 9,904 sq. m (cadastre code: 52.25.31.067; previous number: 52.05.02.019) in the village of Gamarjveba (Shiraki) in Dedoplistskaro;
  • An agricultural land plot of 10,991 sq. m (cadastre code: 52.05.32.035; previous number: 52.05.04.011) in the village of Gamarjveba (village area) in Dedoplistskaro;
  • An apartment of 52.84 sq. m located at 51, Stalin Street (Building 15, Apartment 2) in Dedoplistskaro (cadastre code: 52.08.06.066.01.002) and an apartment of 27.74 sq. m registered at the same address (cadastre code: 52.08.06.066.01.003);
  • An agricultural land plot in the village of Gamarjveba (Taribana) in Dedoplistskaro (cadastre code: 52.05.05.076).

The land plots located Taribana, Dedoplistskaro which Givi Gigauri indicated in his declaration do not correspond to the information in the Public Registry.

Temur Ozbetelashvili, chairman of the Commission on Spatial, Territorial Planning, Infrastructure and Natural Resources of the Dedoplistskaro Municipality Council, submitted his asset declaration on 19 August 2015.

In his declaration, he failed to indicate an agricultural land plot of 2,350 sq. m in the village of Zemo Machkhaani (cadastre code: 52.01.32.109).

The assets indicated by Temur Ozbetelashvili in his declaration are not registered with the Public Registry, specifically, an apartment of 135 sq. m at 42, Rustaveli Street, Dedoplistskaro (Apartment 12) as well as a land plot (arable) located in the village of Zemo Machkhaani in Dedoplistskaro, with an area of 12,500 sq. m; in addition, a land plot of 2,500 sq. m in Dedoplistskaro is registered in the name of his wife, Maia Bostashvili.

 

Gurjaani Municipality

Gurjaani Municipality Administration Head Givi Gergidze submitted his asset declaration on 11 August 2015. Givi Gergidze failed to indicate in his declaration that his wife, Tsitsino Miminoshvili, owns an apartment at Building 18, Vazisubani Settlement, Tbilisi (cadastre code: 01.17.10.002.104.28.042) and part of the property at 13, Melikishvili Street (38.00/668.00) (cadastre code: 01.15.03.017.006.02.515).

He also failed to indicate in his declaration that his son, Ivane Gergidze (personal number: 01020004131), owns an apartment (No 31) with an area of 43.28 sq. m at 66, Irakli Abashidze Street, Tbilisi (cadastre code: 01.14.11.027.007.01.031) and an attic of 38.69 sq. m in the apartment block at the same address (cadastre code: 01.14.11.027.007.01.508).

An income received by his wife from entrepreneurial activities is mentioned in his declaration: Tsitsino Miminoshvili received over GEL 5,000 as a director of the company GG (identification code: 427717250).

Before his wife, Gergidze himself was the head of the company. The incumbent head of the Gurjaani Administration established the company GG on 11 November 2011. Since the company establishment and until 8 July 2014, Gergidze was the owner of 100 percent of its shares and was also its director. As a result of the 14 July 2014 local self-government elections, Givi Gergidze was elected the head of the Gurjaani Municipality Administration and, in accordance with the requirements of the law, he transferred the ownership of 100 percent of shares of the company and the position of the director to his wife, Tsitsino Miminoshvili (personal number: 01017036507).

Since 2012, Kurorti Akhtala, JSC has purchased various kinds of medicines from GG five times through a simplified purchase procedure (the total amount received for the services envisaged by the contract was GEL 12,300).

Elguja Giorgadze, first deputy head of the Gurjaani Municipality Administration, submitted a public official’s asset declaration on 14 December 2015. Giorgadze failed to indicated in his declaration that he has been registered as an individual entrepreneur (personal number: 13001009596) since 16 February 2006.

The information that Giorgadze provided in his declaration about the real estate that he owns is not consistent with the property registered in his name with the Public Registry. Specifically, according to the asset declaration, he owns land plots of 500,000 sq. m, 10,000 sq. m and 10,000 sq. m and residential properties of 400 sq. m and 150 sq. m in Gurjaani.

According to the information of the Public Registry, however, the following real estate located in Gurjaani is registered in the name of Elguja Giorgadze:

  • A non-agricultural land plot of 381 sq. m in Gurjaani with a 393.8 sq. m residential property (cadastre code: 51.08.01.776);
  • An agricultural land plot of 91,200 sq. m, cadastre code: 51.08.52.006; previous number: 51.08.52.005;
  • An agricultural land plot of 50,300 sq. m, cadastre code: 51.08.52.011; previous number: 51.08.52.010   51.08.52.007;
  • An agricultural land plot of 100,000 sq. m, cadastre code: 51.08.58.021; previous number: 51.08.04.017;
  • An agricultural land plot of 94,167 sq. m, cadastre code: 51.08.52.125; previous number: 51.08.04.779a;
  • An agricultural land plot of 1,939 sq. m, cadastre code: 51.08.61.070 ; previous number: 51.08.01.676;
  • An agricultural land plot of 1,415 sq. m, cadastre code: 51.08.61.071; previous number: 51.08.01.675;
  • An agricultural land plot of 1,360 sq. m, cadastre code: 51.08.61.072; previous number: 51.08.01.677;
  • An agricultural land plot of 29,779 sq. m, cadastre code: 51.08.58.102; previous number: 51.08.58.003;
  • An agricultural land plot of 425 sq. m, cadastre code: 51.08.58.103  ; previous number: 51.08.58.103.

Zviad Kvirilashvili, deputy chairman of the Gurjaani Municipality Council, submitted his asset declaration on 13 August 2015.

In the declaration submitted in 2015, Kvirilashvili failed to indicate a 458 sq. m household land plot with a 220.30 sq. m building on it (cadastre code: 51.01.59.214) at 1, Erekle II Street in the town of Gurjaani registered in the name of his wife, Nana Jadugishvili (personal number: 13001011563).

It is noteworthy that this property was registered one month before the asset declaration was filled out, on 9 July 2015.

 

Kvareli Municipality

Kvareli Municipality Council Chairman Jemal Shaverdashvili submitted his asset declaration on 1 September 2015. Jemal Shaverdashvili failed to indicate the following property in his declaration:

  • An agricultural land plot of 11,818 sq. m, cadastre code: 57.07.65.001 (previous: 57.07.08.426) and buildings located on it in the village of Shilda, Kvareli District;
  • An agricultural land plot of 8,349 sq. m, cadastre code: 57.07.65.006 (previous: 57.07.08.416) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 2,150 sq. m, cadastre code: 57.07.65.005 (previous: 57.07.08.418) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 5,529 sq. m, cadastre code: 57.07.65.026 (previous: 57.07.08.423) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 4,452 sq. m, cadastre code: 57.07.65.027 (previous: 57.07.08.430) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 10,289 sq. m, cadastre code: 57.07.65.028 (previous: 57.07.08.433) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 11,020 sq. m, cadastre code: 57.07.65.029 (previous: 57.07.08.434) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 8,161 sq. m, cadastre code: 57.07.65.030 (previous: 57.07.08.432) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 3,765 sq. m, cadastre code: 57.07.65.031 (previous: 57.07.08.431) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 2,152 sq. m, cadastre code: 57.07.65.032 (previous: 57.07.08.428) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 6,758 sq. m, cadastre code: 57.07.65.033 (previous: 57.07.08.427) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 6,731 sq. m, cadastre code: 57.07.65.034 (previous: 57.07.08.422) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 4,710 sq. m, cadastre code: 57.07.65.035 (previous: 57.07.08.414) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 4,916 sq. m, cadastre code: 57.07.65.036 (previous: 57.07.08.421) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 4,873 sq. m, cadastre code: 57.07.65.037 (previous: 57.07.08.420) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 5,375 sq. m, cadastre code: 57.07.65.043 (previous: 57.07.08.424) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 3,187 sq. m, cadastre code: 57.07.65.042 (previous: 57.07.08.415) in the village of Shilda, Kvareli District;
  • An agricultural land plot of 7,931 sq. m, cadastre code: 57.07.65.046 (previous: 57.07.08.417) in the village of Shilda, Kvareli District.

The residential property of 120 sq. m in the village of Shilda in Kvareli District and a non-residential property of 180 sq. m (cow farm) which Shaverdashvili indicated in his declaration could not be located in the Registry.

Koba Pachoshvili, chairman of the Legal Issues Commission of the Kvareli Municipality [Council], submitted a public official’s asset declaration on 18 September 2015. Koba Pachoshvili indicated in his declaration that he owns a 1,500 sq. m land plot in the village of Shilda in Kvareli District as well as a 150 sq. m residential property but, according to the Real Estate Registry information, Pachoshvili owns a 7,540 sq. m land plot (cadastre code: 57.07.65.015) while no residential property is registered in his name.

Paata Nioradze, chairman of the Commission on Economic and Property Management Issues of the Kvareli Municipality Council, submitted his asset declaration on 17 September 2015. Nioradze did not mention in his declaration that he still owns 100 percent of shares and remains the director of Diabazi 2007, LLC (identification code: 241580605) registered in 2007. This is a violation of the Law on Conflict of Interest and Corruption in Public Institutions, according to which a public official is not allowed to hold any position in any enterprise.

Nioradze also failed to indicate in his declaration that he owns the following property:

  • An agricultural (arable) land plot of 18,319 sq. m (cadastre code: 57.03.59.162) located in the village of Chikaani, Kvareli District (previous numbers: 57.03.59.109;  57.03.59.116;  57.03.59.134);
  • A non-agricultural land plot of 80 sq. m (cadastre code: 57.06.60.507; previous: 57.06.60.482 and 57.06.60.362) located at Chavchavadze Street in Kvareli as well as a 24 sq. m property (57.06.56.241) at the same address;
  • Co-ownership of an agricultural (arable) land plot of 3,141 sq. m (cadastre code: 57.03.59.167) located in the village of Chikaani, Kvareli District, former number: 57.03.05.126. Also, a 2,242 sq. m land plot, cadastre code: 57.03.59.168; previous: 57.03.05.123;
  • Also, a 10,795.89 sq. m land plot (cadastre code: 57.03.05.146) located in the village of Chikaani, Kvareli District;
  • A land plot of 6,517 sq. m (cadastre code: 57.06.68.561; previous: 57.06.68.550) and a land plot of 6,175 sq. m (cadastre code: 57.06.68.560; previous: 57.06.68.550) owned by his wife, Lela Bilanishvili;
  • Also, a 35 sq. m property located at 65, Chavchavadze [Street] in Kvareli (cadastre code: 57.06.56.242) owned by his wife, Lela Bilanishvili (the property was sold to another person after the submission of the declaration) as well as a 68 sq. m property (cadastre code: 57.06.25.233.01.504) located at the same address; according to the declaration, Lela Bilanishvili owns a 82 sq. m property, which does not correspond to the property registered with the Public Registry.

Akaki Sepashvili, chairman of the Commission on Spatial, Territorial Planning, Infrastructure and Natural Resources of the Kvareli Municipality Council, submitted his asset declaration on 17 September 2015. Akaki Sepashvili failed to indicate in his declaration that the following real estate is registered in his name:

  • An agricultural land plot of 1,149 sq. m in Kvareli, cadastre code: 57.06.53.247;
  • An agricultural land plot of 1,000 sq. m in Kvareli, cadastre code: 57.06.62.297;
  • An agricultural land plot of 2,414 sq. m in Kvareli, cadastre code: 57.06.62.292, previous: 57.06.15.123 (the area of the plot was 2,350 sq. m but became 2,414 sq. m after precise measurements were taken);
  • An agricultural land plot of 2,811 sq. m and a 227 sq. m building on it at 14, Tsotne Dadiani Street in Kvareli, cadastre code: 57.06.53.244, previous: 57.06.01.480;
  • An agricultural land plot of 4,633 sq. m in Kvareli, cadastre code: 57.06.09.060;
  • An agricultural land plot of 3,712 sq. m in Kvareli owned by his family, cadastre code: 57.06.62.251; previous: 57.06.15.229; the area of the plot was 4,880 sq. m but became 3.712 sq. m after precise measurements were taken;
  • An agricultural land plot of 1,352 sq. m in Kvareli, cadastre code: 57.06.01.041;
  • An agricultural land plot of 9,669 sq. m in Kvareli owned by his family, cadastre code: 57.06.65.181; previous: 57.06.05.533; (note: the property was sold on 24 April 2016);
  • After filling out the declaration, Akaki Sepashvili registered the ownership of an agricultural land plot of 1,546 sq. m, cadastre code: 57.06.65.367.

In his declaration, Akaki Sepashvili mentions his son, Ilia Mzekalashvili, although, according to the information on the official website of the Central Election Commission, the official surname of Akaki Sepashvili’s son is Sepashvili, not Mzekalashvili (personal number: 45001003363), and the following real estate located in Kvareli is registered in his name:

  • A land plot of 8,078 sq. m (cadastre code: 57.06.69.219; previous: 57.06.09.120);
  • A land plot of 6,859.75 sq. m (cadastre code: 57.06.09.119);
  • A land plot of 6,658 sq. m (cadastre code: 57.06.69.249; previous: 57.06.09.072; after precise measurements were taken, the 7,000 sq. m became 6,658 sq. m);

 

Sagarejo Municipality

Council Commission Chairpersons

Nikoloz Vachrishvili, chairman of the Budget and Finance Commission of the Sagarejo Municipality [Council], submitted a public official’s asset declaration on 25 August 2015. Vachrishvili failed to indicate in his declaration that he owns a 3,001 sq. m agricultural land plot (cadastre code: 55.09.66.066) in the village of Manavi in the Sagarejo District.

In addition, the property he declared could not be located in the Public Registry, namely, a 120 sq. m land plot, a residential property, a 1,000 sq. m land plot and a 8,920 sq. ma land plot in the village of Manavi in the Sagarejo Municipality registered in the name of his family members (Nikoloz Vachrishvili – 25 percent, Tornike Vachrishvili – 25 percent, Giorgi Vachrishvili – 25 percent, Gogola Vachrishvili – 25 percent).

The information included in the asset declaration submitted on 10 September 2015 by Eldar Meparidze, chairman of the Commission on Spatial, Territorial Planning, Infrastructure and Natural Resources of the Sagarejo Municipality [Council], is not consistent with the property registered with the Public Registry.

He indicated that a 2,200 sq. m agricultural land plot and a 288 sq. m building located in the village of Ninotsminda in the Sagarejo District are registered in the name of his wife, Mzia Meparidze (personal number: 36001030167) but, according to the Public Registry, his wife owns an agricultural (household) land plot of 2,007 sq. m with a building in Ninotsminda in Sagarejo District (cadastre code: 55.13.51.119).

The property declared by Eldar Meparidze cannot be located in the Public Registry, specifically, a 60,000 sq. m land plot located in the village of Ninotsminda in the Sagarejo Municipality.

 

Lagodekhi Municipality

Kote Kapanadze, chairman of the Budget and Finance Commission of the Lagodekhi Municipality [Council], submitted his asset declaration of a public official on 1 September 2015. Kapanadze indicated in his declaration that he owns a 110,000 sq. m land plot and a 170 sq. m residential property in the village of Kartubani of the Lagodekhi District, however, there is no record of it in the Public Registry. The property he indicated in his declaration does not correspond to the property registered with the Public Registry.

Kapanadze failed to indicate the following property in the document: according to the Public Registry, Kote Kapanadze owns a 265,200 sq. m agricultural (arable) land plot (cadastre code: 54.04.18.009) in the village of Ninigori in Lagodekhi. Also registered in Kapanadze’s name is a 7,815 sq. m agricultural land plot (cadastre code: 54.08.60.051) in the village of Kartubani in the Lagodekhi Municipality. A residential apartment under construction at 50/18, Ketevan Tsamebuli Avenue / Bochormi in Tbilisi (cadastre code: 01.17.13.041.016.01.068a) is registered in the name of Kote Kapanadze as well.

 

Sighnaghi Municipality

Eka Chakhnashvili, deputy head of the Sighnaghi Municipality Administration, submitted her asset declaration of a public official on 8 September 2015. In her declaration, Chakhnashvili failed to indicate that her mother (Amalia Chakhnashvili, personal number: 40001013732) owns a 79.63 sq. m apartment and two basements of 13.62 sq. m and 4.36 sq. m at 51, Chikobava Street in Tbilisi (cadastre code: 01.16.06.026.001.01.510). It is noteworthy that Amalia Chakhnashvili’s date of birth indicated by Eka Chakhnashvili in the filled-out declaration is different from the one on the voter list of the Central Election Commission although other information is consistent, which allows us to conclude that Amalia Chakhnashvili (personal number: 40001013732) is indeed Eka Chakhnashvili’s mother. It is likely that the deputy head of the Sighnaghi Municipality Administration indicated her mother’s date of birth with an error in one [digit].

Council

Gocha Toklikishvili, chairman of the Sighnaghi Municipality Council, submitted his asset declaration of a public official on 28 August 2015. Gocha Toklikishvili did not indicate in his declaration that he owns 100 percent of shares of Kakheti Lands, LLC (identification code: 440388992).

The company, Kakheti Lands, LLC, was registered on 28 March 2012. The current director of the company is Konstantine Toklikishvili.

According to the State Procurement Agency, Kakheti Lands, LLC has never participated in any tenders and has never been awarded a direct purchase contract either.

In the declaration submitted on 28 August 2015, Gocha Toklikishvili indicated that he owns a 15,000 sq. m land plot in Tsnori, while his mother, Elza Toklikishvili, owns a 7,500 sq. m land plot, however, this is not confirmed by the Public Registry information.

Temur Javashvili, deputy chairman of the Sighnaghi Municipality Council, submitted his asset declaration of a public official on 20 August 2015. Temur Javashvili did not indicate in his declaration that he owns 50 percent of shares of Chveni Sopeli, LLC (identification code: 440388527).

The date of the state registration of the company, Chveni Sopeli, LLC, is 17 January 2011. The company’s areas of activity are poultry farming, vegetable cultivation and others. At the time of the company registration, Temur Javashvili was its director. The current director is Malkhaz Begiashvili.

According to the State Procurement Agency, the company has never participated in any tenders and has never been awarded a direct purchase contract either.

 

Akhmeta Municipality

Administration

Vano Naskidashvili, first deputy head of the Akhmeta Municipality Administration, submitted his asset declaration of a public official on 20 November 2015. Naskidashvili failed to indicate in his declaration that his family owns a 3,918 sq. m agricultural land plot in Akhmeta (cadastre code: 50.04.20.318).

Tamaz Kavtarashvili, deputy head of the Akhmeta Municipality Administration, submitted his asset declaration of a public official on 17 February 2016. The areas of land plots indicated by Kavtarashvili in his declaration do not correspond (are smaller) to the information registered [with the Public Registry].

The information indicated by Tamaz Kavtarashvili in the declaration submitted on 17 February 2016 is not consistent with the information [on property] registered in his name with the Public Registry. Specifically, the Public Registry has the following property registered in the name of Tamaz Kavtarashvili: buildings of 1,510 sq. m and 917 sq. m (cadastre code: 50.06.04.002); 1,509 sq. m (cadastre code: 50.06.33.220); co-ownership of 3,454 sq. m (cadastre code: 50.05.33.103); buildings of 711 sq. m, 88.2 sq. m and 6.7 sq. m (cadastre code: 50.06.33.222); according to the declaration, however, he owns land plots of 616.10 sq. m, 820 sq. m and 4,000 sq. m in Duisi, a buildings of 690 sq. m and a residential property of 94.90 sq. m.

Tamaz Kavtarashvili also indicated in his declaration that he owns 18 sq. m of property at 3, Tskhra Dzma Street in Tbilisi, which is not confirmed by the Public Registry information.

Tamaz Kavtarashvili indicated in his declaration that his son, Muslim Kavtarashvili, owns a residential property of 316.60 sq. m and a plot of land of 1,698.40 sq. m in the village of Duisi, however, this is not consistent with the Public Registry information either. Specifically, according to the Public Registry, a 2,015 sq. m land plot and 316.6 sq. m and 31.9 sq. m of buildings (cadastre code: 50.06.33.091) are registered in the name of Muslim Kavtarashvili (08001033842).

Tamaz Tsitelauri, deputy chairman of the Akhmeta Council, indicated in the declaration he submitted on 11 September 2015 that he owns a residential property of 360 sq. m in Zemo Khodasheni in Akhmeta as well as a 5,000 sq. m land plot in Oboldze, a 1,500 sq. m one in Ninikelaant Ubani and a 6,000 sq. m one in Zemo Khodasheni; according to the Public Registry, however, Tamaz Tsitelauri owns a 2,911 sq. m land plot and buildings of 261 sq. m and 128 sq. m (cadastre code: 50.02.33.037) in the village of Khodasheni in the Akhmeta District.

 

Telavi City Hall

Levan Liluashvili, deputy mayor of the Municipality City Hall of the self-governing city of Telavi, submitted his asset declaration of a public official on 8 September 2015. In his declaration, Liluashvili failed to mention several land plots owned by him and his family:

  • An agricultural (arable) land plot of 1,156 sq. m  in the village of Busheti in the Telavi District (cadastre code: 53.02.42.062) – in his ownership;
  • An agricultural land plot of 9,374 sq. m in the village of Khodasheni in the Telavi District (cadastre code: 53.02.33.050) – in his ownership;
  • An agricultural land plot of 3,368 sq. m in the village of Kvemo Khodasheni in the Telavi District (cadastre code: 53.02.41.049) – in his ownership;
  • An agricultural land plot of 2,243 sq. m in the village of Kvemo Khodasheni in the Telavi District (cadastre code: 53.02.34.074) – in his ownership;
  • An agricultural land plot of 2,826 sq. m in the village of Kvemo Khodasheni in the Telavi District (cadastre code: 53.02.40.145) – in his ownership;
  • An agricultural land plot of 787 sq. m in the village of Kvemo Khodasheni in the Telavi District (cadastre code: 53.02.41.095) – in his ownership.

Levan Liluashvili indicated in his declaration that his wife, Tamar Khizanishvili, owns a residential property of 165 [sq. m] at 15a, Chonkadze [Street] in Telavi; according to the Public Registry, however, Tamar Khizanishvili owns 254.4 sq. m at 15a, Chonkadze [Street] in Telavi.

Gia Gigiashvili, deputy chairman of Telavi City Hall, submitted his asset declaration of a public official on 14 September 2015. Gigiashvili indicated in his declaration that his wife, Maia Keinoshvili, owns a land plot of 2,812 sq. m and a residential property of 432 sq. m in the village of Eniseli in the Kvareli District but, according to the Public Registry, a building of 185 sq. m rather than a residential property of 432 sq. m is registered at that address. In addition, the areas of the land plot indicated in the declaration is different from the one in the Public Registry, specifically, a land plot of 12,626 sq. m (cadastre code: 57.08.55.018) is registered in the name of Gigiashvili and not of 12,501.53 sq. m as it is indicated in the declaration.

A land plot of 6,674.56 sq. m (cadastre code: 57.08.05.103) located in the village of Eniseli in Kvareli owned by the family and another one of 5,479 sq. m (cadastre code: 57.08.05.225) in the same village, both owned by the family, are not mentioned in the declaration.

 

Recommendations

Despite the fact that Transparency International Georgia has, on more than one occasion, published studies about undeclared property of public officials in various municipalities and about the risks associated with such undeclared property, examples of submitting incomplete declarations, as we saw in the case of public officials of Kakheti’s municipalities, remain a systemic problem.

In addition, the organization has many times pointed out to the government the need for the elaboration of additional monitoring mechanisms in order to efficiently combat corruption. According to the new Georgian law On Public Service, a part of which is to be put into effect on 1 January 2017, the Public Service Bureau provides for the monitoring of asset declarations submitted by public officials. Transparency International Georgia hopes that this provision will be put into practice and become an effective mechanism of addressing the problems identified in this study.

Transparency International Georgia calls on the municipalities of Kakheti:

  • To ensure that precise information is entered fully and in a timely manner when public officials’ asset declarations are being filled out;
  • To strengthen preventive mechanisms to stop possible corrupt deals;
  • To enhance monitoring mechanisms to prevent all kinds of conflict of interest in public procurement.
